
Policy
PAYMENT
All lessons must be prepaid to ensure an instructor can accommodate the duration of the lessons and help give our instructors a more predictable schedule since they are commuting to individual pool locations.
If you want to split your payments, we do offer this option upon request.
Payments must be made within 24 hours of receiving an invoice after a schedule has been agreed upon or on the first day of lessons. If payment is delayed further than 24 hours there is no guarantee that your scheduled dates will still be available. Please pay promptly to assure you get your requested dates and times.
Any money given to an instructor directly is considered a tip. Tips are not mandatory, however, they are greatly appreciated at the end of the lesson package for a job well done.
Payment can be made by Venmo, Cash, or Check. I will send you an invoice of how much you owe through the email that was provided.
REGISTRATION FEE
A one-time $25 non-refundable registration/insurance fee per child, will be charged and added to your first swim lesson.
MAKE-UP POLICY
We are focused on providing the best swim lesson experience possible. When you enroll your child into a class, the class time is held exclusively for your child each week until you don’t renew your package; you are paying for your child’s spot in their class, not their attendance. The consistency of attending this scheduled class is one of the keys to our program. However, we recognize that conflicts do arise from time to time. To address this, Ohana Swim Academy’s make-up policy has been designed to find a fair and fluent system on occasions when conflicts do arise. The policy is as follows:
Each student is allowed three make-up sessions per package.
We cannot schedule a make-up for a make-up. Once booked, if you don’t attend your make-up class, you lose it. Makeup cannot be rescheduled.
If you are finding that you must miss your regularly scheduled class on more than three occasions, we would be happy to find a new day at a more convenient time.
If you need to cancel a lesson, instructors need to be notified within an hour of the lesson start time. You will be penalized for a late notice fee of $30 and you will lose the lesson.
Late Lessons
If you are late for a lesson you will lose the time that you missed for that scheduled lesson. The lesson will end at its scheduled end time. Our instructors are on a scheduled time and may need to get to another lesson.
If the instructor is late to a lesson, the instructor WILL make up the time that is being missed. If the instructor is late and you have not been notified, please get in touch with ohanaswimacademy@gmail.com or contact our Director immediately. The number is on the contact page (There is a contact tab at the top of the page or there’s a link at the bottom).
- If the instructor is constantly late, please contact us and we will provide you with a new instructor.
Cancellations Due to Weather
If you want to cancel lessons due to inclement weather (cold or slightly rainy weather) to insure the comfortability of your child/children and our instructors have not contacted you yet, you may cancel the lesson. It must be done with at least 1 hour’s notice prior to the start time to the instructor via text or phone call or you can also send an email to ohanaswimacademy@gmail.com. High temperatures are not considered a valid reason to cancel lessons due to weather. Please contact your instructor at least 1 hour prior to the lesson start time if you need to cancel due to weather.
-Any rain during the time of the scheduled lesson (drizzling to downpour) will be canceled to ensure the safety and well-being of the child/children taking lessons. Please contact your instructor as the situation with rain may be worked around with the rainy weather (off and on rain). Our instructors look at their weather app and if they deem a reason to cancel due to weather, the lesson will be rescheduled. You will not be penalized for a make-up lesson for the weather.
Cancellation by Ohana Swim Academy LLC.
We reserve the right to cancel the swim lessons without refund if the swimmers refuse to have lessons, are extremely disorderly, inappropriate, and/or create a risk of harm to themself or others. Inappropriate conduct includes, but is not limited to the following: biting, scratching, spitting, excessive crying and yelling, and exiting the pool without permission. If a lesson is canceled due to the inappropriate conduct of the swimmer, the remaining lessons will be forfeited and no refund will be issued.
If an instructor cancels a lesson because they are unable to provide the lesson, a new lesson will be scheduled and you will not be forfeited with a make-up lesson. Our instructors are able to cancel a lesson if issues arise and are unable to provide the lesson for that day you scheduled a lesson.
Covid-19 Policy
We want to make sure that everyone is safe and we do not want to spread the illness to others who are having lessons. Here at Ohana Swim Academy LLC, we take full precautions to ensure that everyone is safe. If Ohana Swim Academy LLC has to cancel due to any close contact or contraction of COVID, lessons will be canceled and lessons will not be lost. IF YOU HAVE TO CANCEL THE LESSON DUE TO COVID, it will be a missed lesson and you will have to use your makeup lesson. We have in place that you are allowed 3 makeups per package.
If Covid becomes a bigger issue where we are forced to cancel lessons, we will wait until it is safe for lessons to continue. This will be determined by the instructor. All dates that Ohana Swim Academy LLC wants to have a start date to continue lessons again are not set in stone. Things may change and we may need to start at a different date.
If you wish to cancel all lessons due to Covid but want to continue later when it becomes safer to continue, then we will hold your lessons until a year from when you want to stop. If you wish to cancel lessons completely due to COVID and do not want to continue, all lessons that have not been completed will be forfeited. This does not qualify for a full refund.
With any signs of sickness please take precautions and cancel lessons. Our instructors try their best on staying healthy to work and we do not want to risk their job or safety.
REFUND/WITHDRAW POLICY
If you at any point want to withdraw from lessons you will need to fill out a withdrawal form.
Refunds will only be given under two circumstances:
We are unable to fulfill your scheduling requests before lessons begin. Or if you are truly unhappy with the lessons that our instructors are being offered to your child/children.
Refunds are for the 100% Satisfaction Guarantee with lessons.
To receive a full refund you must email us at ohanaswimacademy@gmail.com within 24 hours of your first swim lesson before a second lesson takes place, and we can refund your entire lesson purchase.
Clients may be subject to a $50 cancellation fee once 24 hours have elapsed after the first lesson. Once a second lesson has taken place, there is a $50 cancellation fee to cancel the remaining lesson time.
If you are unable to complete all of the lessons in the package due to illness, scheduling conflicts, or Covid, all unused or unscheduled lessons will be honored for one year from the date of booking.
We would like to finish the package that you have chosen for your child/children.
A child not wanting to do lessons or constantly crying AFTER the first lesson is completed is not a reason for a refund.
SWIM DIAPERS
All children under the age of three and any child who is not entirely potty trained are required to wear a swim diaper. The diaper must fit SNUGLY around the legs and waist. The elastic should leave a slight mark.
CLASS CANCELLATIONS AND CONSOLIDATIONS
If we must cancel classes for circumstances beyond our control, we will schedule a new start time to when we are able to have lessons again.
If we have to cancel lessons because we are unable to use the pool we were currently using, then you will need to find a new pool/place for us to continue lessons and a new start time and date will be scheduled. We do not provide the pool, we provide the lessons at the pool that is convenient for you for us to use.
If an instructor is unable to make it to a lesson they will notify you promptly, and a new lesson to make it up will be scheduled. This does not qualify for a missed lesson on your package.
DURING CLASS LESSON
**Parent/Care-taker MUST be present during child’s entire swim lesson**
- You are not required to purchase or bring toys to the lesson. They will be provided by the instructor.
- Parents or guardians are not required to be in the pool. If you’re doing a learn-to-swim lesson, kids 2 and under might feel comfortable with you in the pool, but we want the child to learn and adapt on their own.
Crying may happen and our instructor will continue lessons if a child is crying. We want to build a relationship with the child so that they become comfortable with us and are able to learn how to swim.
- Make sure your child/children are prepared to have swim lessons.
Goggles are not required but are recommended.
Parking
The client must provide parking for the instructor. If there is no parking space available for the instructor and the instructor has to pay for parking, the client must pay for the instructor’s parking. The client can give the instructor cash at the lesson, or Ohana Swim Academy can invoice the client for the costs of parking.
Liability Release
As the legal parent or guardian, I release and hold harmless Ohana Swim Academy, its owners, operators, and instructors from any and all liability, claims, demands, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by the swimmer and/or myself, while in or upon the premises or any premises under the control and supervision of Ohana Swim Academy LLC, its owners, operators, instructors, and pool hosts. In no event shall Ohana Swim Academy LLC be liable for any injury, loss, claim, or damages (including indirect, special, exemplary, punitive, incidental, or consequential damages) of any kind, whether based on contract, tort, or otherwise, which arises out of or in any way connected with (I) any use of the services, the site, or its content, (II) any failure or delay (including, including but not limited to, the use or inability to use any component of the services) or (III) the performance or non-performance of any instructor or client in connection with the services, even if Ohana Swim Academy LLC has been advised of the possibility of such damages. I understand that I am voluntarily participating in Lessons and that I waive and release any and all claims for damages of personal injury, death, or property damage that may have or will occur as a result of participating in Swim Lessons.
Assumption of Risk
I understand, agree, and acknowledge that there are risks inherent in the sports activities conducted by Ohana Swim Academy LLC including, but not limited to, paralyzing injuries, brain injuries, and death. These activities may be of a hazardous nature and/or may include activities such as swimming, diving, and a variety of strenuous exercise and physical activities. With a full understanding of the facts, I state that to the best of my knowledge, my son/daughter/grandchild/relative/individual listed has no medical, physical, or emotional health conditions that would hinder or prevent my/his/her participation in Ohana Swim Academy LLC programs. I hereby knowingly assume the risk of any injury to myself and/or my son/daughter/grandchild/relative/individual that could result from their participation in Ohana Swim Academy LLC activities.
I understand, agree, and acknowledge that swimming can be dangerous and the facilities at which a lesson takes place may contain hazards that could result in my or my children’s injury or death and/or damage to my property. I assume all risk of injury, death, and property damage related to all lessons scheduled through Ohana Swim Academy LLC. Ohana Swim Academy LLC does not inspect or maintain any facilities at which any lesson takes place, does not provide any equipment used at any lesson, and is not responsible for the behavior of any client or instructor. By scheduling a lesson, you agree that Ohana Swim Academy LLC has no liability for any injury, death, or property damage suffered by you/your child/your relative/your legal guardianship in connection with such lesson.
Electronic Signature
The Swim Lessons Agreement is an electronic contract that governs your use of and access to the Ohana Swim Academy LLC website and services. Upon agreeing to the Swim Lessons Agreement when completing the swim lessons registration form, you acknowledge that you understand and agree to be legally bound by the Swim Lessons Agreement and the terms, conditions, and notices contained or referenced herein. Checking the box creates an electronic signature that has the same legal force and effect as a handwritten signature.
